FTC v. Meta: The High-Stakes Legal Battle Over Instagram and WhatsApp

The much-anticipated trial between Meta and the Federal Trade Commission (FTC) officially began on April 14th, with crucial arguments set to unfold over the next two months. DC District Court Chief Judge James Boasberg will oversee the case, which centers on whether Meta violated antitrust laws by monopolizing the market for “personal social networking services” through its acquisitions of Instagram and WhatsApp.

The FTC initially brought the case in late 2020, but the judge dismissed it at first. However, after the FTC revised its case with more detailed allegations of Meta’s monopolistic behavior, the case was allowed to proceed. Now, the court will focus on whether Meta’s acquisition strategy unlawfully stifled competition in the social media industry. If Meta is found to have violated antitrust laws, the court will later decide on appropriate remedies, including the possibility of forcing the company to divest Instagram and WhatsApp.
