Florida Man Accused of Fatally Shooting Stepson During Argument Over Fortnite

A 26-year-old man died after a violent argument over Fortnite erupted inside a Florida home.

Police officers from Davenport rushed to a house on Citrus Landing Boulevard after receiving a call about a domestic dispute. Inside the home were Kelly Agar Garcia, 43, his wife Adriane Daza, 48, her two younger children aged 9 and 11, and her adult son Azareel J. Martinez.

The situation escalated when the 9-year-old played Fortnite on a phone, despite his mother’s warning not to. After Daza took the phone away, the upset child grabbed a Smith & Wesson 9mm handgun from her nightstand.

Daza tried to get the weapon back but failed. Garcia stepped in and managed to take the gun from the child. Then Martinez entered the room and started an argument over Fortnite with Garcia. The conflict intensified quickly.

Garcia pulled out the same gun and shot Martinez multiple times in the chest and stomach. Martinez turned to leave, but Garcia fired again, hitting him in the back. Martinez collapsed in the home.

Family members transported him to a nearby hospital. Doctors could not save him. He died shortly after arrival.

Police Chief Steve Parker spoke during a press briefing. He expressed sorrow over the tragedy and highlighted the role of unsafe firearm storage. He said, “If the child didn’t know where the gun was, none of this would’ve happened.”

Police arrested Garcia on the same day. They charged him with second-degree murder and unlawful firearm storage that allowed a child access. Officers booked him into Polk County Jail, where he remains in custody.

Officials also confirmed that child welfare services had previously visited the family’s home. They refused to provide further details due to legal limitations.

This argument over Fortnite has shocked the community and renewed calls for responsible gun ownership. The incident shows how fast a family dispute can turn deadly.
